These terms apply specifically to our free hosting account holders. If you have a paid hosting account please see http://www.freebeehosting.com/billing for your terms of service.
Welcome to FreebeeHosting's free web hosting terms of service! It is important you read this document in its entirety. By signing up for our free hosting you are agreeing to everything on this page. Below are some key points:
No Warez! - Absolutely under no circumstances do we allow any type of illegal or copyrighted material on our servers. Violation will result in the immediate deactivation of services without refund of any kind, we have a zero tolerance policy regarding this.
Inactivity - We actively remove accounts based on inactivity. At a minimum you are required to login to your account control area (DirectAdmin or Freebeehosting.com/login) once every three months.
Continuous Applications - We strictly forbid any kind of bot/script/application that runs constantly. The provision of free hosting is for a website, not for hosting other applications.
File Hosting - Every file on your account must be relative to your website(s), we are not a file storage service and we strictly prohibit scripts including, but not limited to, torrentflux or rapidleech.
Crons - Available on request. Must not be used for external data of any kind. Iterations must be more than once every 5 minutes
While we have highlighted some important items from our terms of service, it is still important to read through the rest of the document, by signing up for a free hosting account you are agreeing to everything on this page.
1. SERVER USAGE
Personal accounts are to be used by the primary owner only. Personal account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads. FreebeeHosting reserves the right to refuse service and/or access to its servers to anyone. Each individual is allowed ONE account only. FreebeeHosting does not allow any of the following content to be stored on its servers, or made accessible in anyway.
Illegal Material: This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State, or Local regulation.
You may not store, under any circumstances, copyrighted Mp3s, videos, applications or games or your account.
Adult Material: Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of FreebeeHosting.
Warez: Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing, etc... This also includes any sites which provide "links to" or "how to" information about such material.
Proxies: We do not allow any kind of proxies to be used on our servers, for any reason.
File Storage: Accounts are not to be used for file storage, your account will be immediately and permanently terminated if found to be in violation of this rule. Downloads are only allowed on your FreebeeHosting account if relate directly with your website and do not violate any part of out terms of service. e.g. you developed custom software and are selling it or giving it away. Accounts may not be used for mirrors, game file hosting, or any other type of file hosting not specified here.
Script Hosting: Space provided by FreebeeHosting is to be used to create a functional website, we do not allow bots, content scrapers, or any other script that runs continuously on your account. Any scripts that are executed via cron or manually must be directly related to your website.
Crons: We do not allow more than one cron within a 5 minute time period per account. This means if you have two crons you must make sure that both do not go off within 5 minutes of each other.
2. SPAM POLICY
FreebeeHosting servers may not be the source, intermediary, or destination address involved in the transmission of Spam, Spamware and other Spam Software or misuse of SMTP. Client's domain or IP may not be referenced as originator, intermediary, or reply-to address in any of the above.
FreebeeHosting considers Spam to be any mass unsolicited message in the mediums of newsgroups and e-mail.
The actions stated above will not be tolerated. Violation will result in the immediate deactivation of services without refund of any kind. Furthermore, a fine of one-hundred (100) US dollars will be imposed for each spam policy violation. FreebeeHosting is the sole arbiter as to what constitutes a violation of the above provisions.
Running a mailing list will result in account immediate termination.
3. SERVER ABUSE
Any attempt to undermine or cause harm to a FreebeeHosting server or another FreebeeHosting Client is strictly prohibited.
Any attempt to undermine any FreebeeHosting web site or a web site of another FreebeeHosting Client is strictly prohibited and may result in immediate termination of services rendered by FreebeeHosting without refund. FreebeeHosting is the sole arbiter as to what constitutes a violation of the above provisions. A fine of two-hundred (200) USD may be implemented for intentional server abuse.
4. HIGH RESOURCE USAGE POLICY
Resources are defined as bandwidth and/or processor utilization. FreebeeHosting may implement the following policy to its sole discretion: When a website is found to be monopolizing the resources available FreebeeHosting, reserves the right to terminate that account immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby FreebeeHosting continues hosting the website for an additional fee.
5. CANCELLATION & REFUNDS
FreebeeHosting reserves the right to cancel any service provided at any time. In this event customers will be entitled to a prorated refund based upon the remaining period of membership. If a customer contravenes FreebeeHosting's terms of service, a refund will not be issued in the event of a cancellation by FreebeeHosting or the customer. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation. Fees charged on a prepay basis are non-refundable.
6. INDEMNIFICATION
Client agrees that it will defend, indemnify, and hold harmless FreebeeHosting from any and all demands, fines, liabilities, losses, costs, claims, and expenses, including attorney's fees, asserted against FreebeeHosting, its employees, officers, agents, and directors that may arise or result from any service provided or performed, or agreed to be performed, or any product sold by Client, its employees, officers, agents, and directors.
The Client agrees that it will defend, indemnify, and hold harmless FreebeeHosting against any liabilities, including but not limited to, those arising out of (1) any injury to person or property caused by any product sold or service rendered or otherwise distributed in connection with FreebeeHosting's servers; (2) any material supplied by the Client infringing upon or allegedly infringing upon the proprietary rights of a third party; (3) copyright infringement; and (4) any defective products sold to the Client's customer from FreebeeHosting's servers.
FreebeeHosting assumes no liability of the Client for failure to follow this Agreement and any results caused by the acts, omissions or negligence of the Client, sub-contractor or an agent of Client or an employee of any one to them, including, but not limited to, claims of third parties arising out of or resulting from or in connection with the Client's products, messages, programs, caller contracts, promotions, advertising, infringement or any claim for libel or slander or for violation of copyright, trademark or other intellectual property rights.
7. SYSTEM BACKUPS
Backups are the sole responsibility of the client. FreebeeHosting retains and offers backups to the client but does not guarantee this service from failure. It is recommended all clients keep their own backups.
8. INACTIVITY
Accounts found to be inactive are suspended for a 10-day period and then terminated. All data including any type of backup or stored information is removed with the account. To prevent an account from being suspended for inactivity it is required users visit their FreebeeHosting control panel (DirectAdmin or Freebeehosting.com/login) at least ONCE every THREE MONTHS. Accounts must also have a working website within one week of sign up.
9. SURVEYS & NEWSLETTERS
FreebeeHosting require all clients to complete regular surveys. These surveys are automatically generated and may be presented to you a maximum of once in every 3 month period. When presented with a survey you must complete it within 10 days or your account will be considered inactive and as such suspended for a 10-day period and then terminated.
We will also send regular emails to your registered email address. These emails will be in the form of a newsletter and may contain advertisements. You are required to supply a valid email address on registration, if your email address is found to be invalid your account will be subject to suspension without notice. To opt-out of these emails closure of your FreebeeHosting account is required.
